Litigation Support Specialist and the FRCP Amendment

There are many litigation support specialist firms or service providers who have been employing legal experts for e-discovery based litigation support. Today litigation has become complex and demanding and this is due to the modern marvel of instant and unlimited electronic information made available due to advancement in digital web technology. There is more information to be accessed and processed every step of the way in litigation and one must know where to draw the line.

Off late there has been a change in the way litigation support specialist work is done especially the E-discovery related services because of the new federal amendments that has come into effect. According to the new amendment metadata should be thought of as information associated with a document that is not visible in the normal viewing or printing of that document. Companies will now have to retain all their emails and communication or may find themselves at risk in the future.

ON April 12, 2006, the Supreme Court amended the Federal Rules of Civil Procedure (FRCP) that address the discovery of ESI (electronically stored information.) The new rule was passed and came into effective from Dec. 1, 2006. It now allows documents unknowingly produced by lawyers to be either returned or destroyed. Attorneys and lawyers must conduct a good and efficient document review before producing any documents that could make them or their clients vulnerable in the future. There are two technical legalese terms one must comply with in litigation. They are the “clawback” agreement and the “quick peek” agreement.

It is now known after six months of the new regulation that the demand of this new FDA amendment is not very easy for everyone to comply with immediately, and many companies both big and small within USA are still struggling with it. This is because it requires cooperation between different departments like IT, legal, records management, etc to successfully implement it.

What are the other basic needs for the online litigation support specialist? Besides being good at extracting information from databases, some of the main functions and features of the outsourced litigation support specialist services include support in,
