Legal Wiretap Transcription

In the US wiretapping or telephone tapping refers to the monitoring of the telephone or the Internet by a third party usually in a hidden way. The United States Foreign Intelligence Court of Review can authorize any federal agents to wiretap the telephone and Internet for use as evidence in court (better known as lawful interception) which is usually approved only when other ways of detecting criminal activity is not possible. The wiretapped recorded conversation on the phone is often transcribed (converted into text form) by a professional transcriptionist and the typed transcripts later becomes a legally authorized documents that can be produced in court during litigation and trial. It is believed that it was wiretapping and intercepting of phone calls to his second wife in Beirut that led to locating the hideout and arrest of the Iraqi dictator Saddam Hussein.

Wiretap on a computer network was first ordered in 1996 when a hacker tried to enter the Harvard University and US military websites and computers. Recently there was a controversy after the Bush administration authorized the National Security Agency (NSA) to used legalized but warrant-less surveillance of suspected international Al Qaida terrorists within and outside the US. Even though wiretap as evidence has been used in the US since many years, in the UK the government has only recently started considering the introduction of wiretap as court evidence after its latest review of antiterrorism legislation.

Besides wiretap transcription there are many other types of specialized legal transcription services that are offered by professional legal transcription companies like,

  • Date of document
  • Title of document
  • Author's name
  • Recipient Box number
  • Type of Document
  • Document source
While indexing of the legal documents and objective coding there are different options are made available. They are,
  • Indexing according to inventory
  • Legal transcription
  • Detailed indexing that includes, detailed outlines of important issues, priority ratings, plain summary

Legal Citation Principles

During the writing of any legal document, other sources or documents of authorities have to be always referred to. These are called as legal citations. Every legal citation has to come under one of the following categories of citation principles.
  • Case citation
  • Legislative citation
  • Treaty citation
  • Government document citation
  • Law periodical citation
Case citations are used by the common law countries to find the location of past court cases. The citation standard varies from country to country. Following is the list of citation standards used by the respective countries.
  • AGLC - Australian guide to legal Citation available at http://mulr.law.unimelb.edu.au/aglcdl.asp
  • Statutory Instruments Practice - United Kingdom
  • McGill Guide - Canadian
  • ALWD Citation Manual / Bluebook - USA
  • Leidraad - Dutch
Law professional always have to decorate their arguments with good legal citations that usually include supporting references to statutes, regulations, and prior appellate decisions besides secondary reference like treatises, restatements, and journal articles. Legal citation writing is a form of technical writing in itself that is a little difficult to master. In the USA, the ALWD Citation Manual: A Professional System of Citation (3d ed. 2006) made by the Association of Legal Writing Directors is well accepted in all law schools.

Real Time Trial Transcription

Real time transcription refers to the transcription process done by the court reporters and transcription professionals who use the latest technology called CAT (computer aided transcription) where within a few seconds of a word being uttered in court, it gets recorded as text format and displayed on a computer screen. This technology uses software that allows those involved in the court to instantly take notes or make highlight on these recordings for later reference.

Real time transcription of trials and depositions can be done at a speed of more than 200 words per minute. Some of the advantages of real time transcription include,

  • Can take and incorporate notes with transcription
  • The attorney need not focus/strain on capturing of any data
  • Easy marking/ annotating/ coding
  • Can be sent over the Internet instantly
  • Instant review of witness response is made possible
  • Can include comments/suggestion
  • Remote participation facilitated
Some of the disadvantages of real time transcription come from the fact that one has to increasingly depend on the skill of the court reporter and the speed with which he is able to convert audio into text without mistakes. Real time transcription is also more expensive in comparison to regular not real time transcription.

An example of real time transcription software is Livenote (A Thomson Corporation product), details are available at http://www.livenote.com

The Benefits of Arbitration

Arbitration is the alternative choice available to resolve disputes without going for litigation or trial. Both the parties have to agree that a third party arbitrator will act as both judge and jury. Arbitration can be binding or nonbinding. Quite often the parties may agree to follow the rules put down by the AAA (American Arbitration Association).

It is well known that litigations can be for a very long period of time and often can take years to settle. Unlike in litigation, during arbitration the rules of evidence and related procedures become quite relaxed. One can generalize and expect the following benefits during arbitration.
  • Less expensive than litigation
  • Faster process
  • Lesser involvement with lawyers
  • Binding and non binding arbitrations possible
  • An arbitrator's fee is lesser than that of a lawyer
  • Helps sooner settlement in non binding arbitration
  • As the arbitrator is not bound by the procedure rules he is more practical
  • No appeals can be filed on a binding arbitration
Before deciding on arbitration it is essential for the client to reflect and see if arbitration should be preferred over litigation after considering all what is at stake including time and the money involved. The arbitration clause has to be well reviewed, if necessary with the help of a lawyer.

Managed Outsource Solutions (MOS) is US based legal services provider offering outsourced professional services in online legal arbitration, legal documentation, legal consultation, legal transcription, legal research and litigation support to clients in the UK, USA, Canada and Australia.

Redefining E-discovery in Litigation Support

Legal communities and specifically the professional litigation support professionals have been facing a challenging situation in E-discovery and document review for some time now. Ever since the recent changes were made to FRCP it is obvious that in no litigation can avoid technology to face the ever expanding universe of electronic evidence. The olden ways of working with huge boxes of files at the law firms are over. According to Forrester research the spending in E-discovery alone is going to increase five fold in the next five years. However there has been a constant struggle to make the process of document review as quick and user friendly as possible considering the huge quantity of data made available and the drain in terms of time and money.

The new technology in E-discovery is basically a data analysis concept that brings back a tinge of the traditional methodology of searching through groups of relevant document. This new enhancement in e-discovery technology is referred to by different terms in legal circles including, conceptual review, topic review, and data clustering. Instead of searching through millions of documents each time using keywords, the new method groups the data/document according to topic/theme even before the document review process begins, so that one will know beforehand what can be expected in a set of data. Now it has become easier to search for your needle in the haystack. Benefits include better workflow and work organization according to skill.

More details on the technology and how it compares with the earlier technologies can be got at http://www.ontrackinview.com/whitepaper/topic2006.pdf . Litigation support professionals will love to see the latest issue of the litigation support magazine for more information on this new concept review technology at http://www.litigationsupporttoday.com/LST%20AUG07-FULL.pdf#page=8

Managed Outsource Solutions (MOS) is a US based legal outsourcing company and legal services provider that offers professional yet affordable outsourced nationwide litigation support, document review, legal documentation, legal transcription, legal web design and legal research services to clients in the US, the UK,Canada and Australia.

Knowledge Discovery

Knowledge discovery refers to discovering intelligent data from a huge set of digital database. The quantity of information and data is so much that one could get lost in it. How do we sort about and move such huge quantities of data? Well today there are specialized techniques that are used to move around data, analyze them and also identify useful patterns within them. This is the process called knowledge discovery in data base and data mining is an application of knowledge discovery.

Knowledge discovery is actually from the field of computer science and the term software mining is related to data mining where knowledge discovery is made from existing software systems.

The following are the input data for knowledge discovery.
  • Gene/protein sequences
  • Databases
  • Data warehouses
  • TextGraph mining (molecules)
Once knowledge discovery has been made it has to be used and applied in different areas. Hence the output of discovered data is very important. Some of the knowledge discovery data output formats include,
  • KDM (knowledge discovery meta model)
  • Metadata
  • Knowledge representation in Artificial intelligence
  • Business rule/ logicSoftware metric
  • BPMN (business process modeling notations)
Managed Outsource Solutions (MOS) is a US based company that offers a wide range of solutions in data management and data mining and offers its clients in the US, Canada, Australia and the UK, affordable services like data mining, knowledge discovery, data entry, data processing, data cleaning, data capture and data extraction from the web.

Data Entry Personnel

Companies and business houses are constantly facing the challenge of managing documents and data that is essential for its day to day successful operations. Specialized databases are maintained by companies with the need for accessing it continuously and efficiently. Further data has to be kept up to date to be really useful. Therefore handling of all such information in big companies is done by data entry professionals that include, data entry operators, electronic data processing personnel and key punchers etc.

Professional data entry personnel's work can involve,
  • Word processing of reports, letters/text
  • Preparing standard forms
  • Prepare statistical tables
  • Preparing master copies
  • Compilation and rearrangement
  • Editing / revising text
  • Transcription
  • Filing, using OCR ( optical character readers)
Some of the different types of equipment used by the data entry personnel include computers, machines that convert typed matter into tapes that later feed the computers, online terminals, OCR, scanners, data entry composing machines, printers, tape readers, disks etc.

Data entry personnel usually work for a minimum of 40 hours every week. They are used to working for long hours and usually have to put up with a lot of noise in the office environment that comes from many different machines all working simultaneously. The regular data entry worker is prone to injury including neck and eye strain. A lot of emphasis is given in offices today for designing of ergonomically oriented interior and office furniture that can prevent such injury including carpel tunnel syndrome that affects the wrists.

Managed Outsource Solutions (MOS) is a US based company that offers a wide range of data entry services like online and offline data entry, key data entry, numeric data entry, data processing, data mining, data cleaning, KDD, OCR, ICR and data extraction services to clients in the US, Canada the UK and Australia.

Patent Infringement Insurance

Patent infringement is very common these days and the cause for one of the most time consuming and challenging national / international litigations. Piracy is rampant and it is not always that the parent company even comes to know about the patent infringements taking place abroad. However there are insurance companies that provide patent litigation insurance (PLI) to protect the inventor or a third party from the risk of patent infringement. The legal cost of patent litigation is usually high and this can also be totally covered by the insurance company.

A regular patent litigation case in the US runs into millions of dollars and so and is not usually taken up as a business investment. Patent infringement is highest in the health and pharmaceutical sectors. The three basic types of insurance policies available today are,
  • Defense and indemnity - Insurance company will pay all liabilities/damages to the insurer
  • Only defense policy - reimburses only the cost of defense
  • Enforcement coverage policy - pays all legal/litigation expenses to go offensive against the infringer
Patent infringement insurance is bound to be more popular in the future. It is very much essential for the smaller companies who will not be able to afford patent litigations due to the high costs involved. High tech companies that have a developed research and development wing should have a fixed budget for patent litigation and must keep in touch with the outside patent counsel and clearly communicate their objectives and expectations from a patent litigation case.

Managed Outsource Solutions (MOS) is a US based legal outsourcing service provider who offers very affordable but high quality legal services including, intellectual property litigation, IP research, patent litigation, patent infringement litigation, legal transcription, legal documentation, litigation support, legal animation, legal website design, and legal coding services to its clients in the US, the UK, Canada and Australia.

Legal Animation for Litigation

Lawyers have to be good litigators and good litigators should be able to carry forward and retain the interest of the audience and jury effectively. Hence most of the litigating lawyers are good at story telling and have the expertise in teaching and also to a certain extent are able to entertain the audience. During litigation it is often a challenge to bring out the truth. The whole plot is seen by the lawyer and his job is to present the different characters systematically and most effectively. Hence it becomes necessary to dramatize certain aspects and evidences that will other wise remain hidden from the outer world. This is possible through legal animation.

Legal animation involves use of 2D/ 3D animated graphics and visuals, which usually imitates an event that has occurred. This is achieved using computers and professional animation experts who can recreate an entire event graphically and animate it such that it can convey the subtle features that have to be brought out for the jury and audience to understand. The main objective of the litigator is to maker the legal animation a very memorable, powerful and effective experience for the jury. Different perspectives are used in animation to give different views to the same event and this can be an eye opener to the audience.

Some examples of legal animation used during litigation include,
  • Reenactment of an accident on highway
  • Showing the effects of slow poison on the brain
  • Explain reverse engineering of duplicating a patent product
  • Forensic animation
  • Technical Charts/stills
  • Evidence for the timing of a gun
  • Recreating the past of a city street

Legal transcription like any other transcription requires the transcriptionist to coordinate his ears, eyes, fingers and sometimes the foot pedal as well. A transcription error/mistake can be defined as a type of data entry error that is made by a human operator. Quite often while the transcript is being typed, the operator touches his fingers in the wrong place on the keyboard and this can result in a typographical error.

There are many other types of errors like typing the wrong syllable, omitted word, and wrong punctuation spellings, etc. What are the different causes for these errors in legal transcription? Well some of the basic reasons for errors in transcription include,
  • Passive listening skills
  • Difficult accents in dictations
  • Problem in audio/video recordings
  • Poor judgement of the case by the transcriptionist
  • Skipping the editing/proofreading process
  • Not well experienced in legalese / legal terms
  • Misdiagnoses of errors
  • Error due to wrong OCR/ICR readings
  • Illegible writing
  • Syntax error
It is very essential to use the latest digital technologies while doing legal transcription and all transcription work should always be done under the supervision of experienced law professionals. Legal research involves searching for some authority so that it can be connected and used with a different set of fact or issue. The amount of authoritative documents is quite large and the legal research professional will have to develop the skill to analyze the situation after a proper understanding of the different search techniques of legal research. A legal research has to develop awareness for the primary sources of law include different opinions of the judiciary known as cases and legal enactments also known as a statute.

What are the sources available for doing legal research? Well because of the great explosion in the IT sector legal research is no more like before. Earlier there were only limited sources that were looked into to by the legal research professional and lawyers but today there are huge volumes of document available and it becomes necessary for the law professionals to search them all. As the data available is quite large it is for the person to decide for himself how much time has to be spent on doing legal research.

Premium electronic primary sources are offered by the Lexis and also by the Westlaw systems. The Internet is also a good source for limitless materials that can not be found any where else. However many online site's authoritativeness has to be questioned. More over the cost of searching huge quantity of documents has almost become prohibitive for many clients. Legal Process Outsourcing and Being Collaborative

Legal Outsourcing is here to stay. Here are a few points to assert it.
  • Ethics opinion supporting legal outsourcing have been issued by bar associations
  • Forrester Research predicts 4 billion dollar industry by 2015
  • Global certification programs for LPO have started
One of the basic necessities in outsourcing especially in legal process outsourcing is the need to be collaborative, something that has probably not been much in the line of the lawyers work until now. The lawyers are different from the IT and business people who have always been used to working in collaboration. Conventionally the law communities dig deep into any contract before signing it. But now it will have to be different. They will have to see the long term benefits and see issues with a larger perspective with the major focus on the economic advantages of LPO deals.

Some of the challenges faced and the work to be done by the outsourcing lawyers include,
  • Ask all types of questions like who why and what about the contract
  • Vendor due diligence is a must
  • As time is critical every aspect of deal/project should have a definite time frame.
  • Communicate first with the service provider/ supplier and help formulate a method of collaboration between the outsourcing law firm and the offshore firm that is going to do the work.
  • Avoid pushing hard and using less tactics while negotiating
  • Should be able to identify potential risks of deal beforehand if any
  • Involve less people and try to close deals discussing the essentials
Like in all industries, innovations and process changes also happen in the legal services sector. Quick recent changes in the legal arena have been the need for e-discovery and outsourcing. These were expected as it is a direct result of growing technology and globalization. Over the years the legal industry will adapt itself and accept legal outsourcing / offshoring not as a necessary evil but as a welcome change for the better future.

Managed Outsource Solutions (MOS) is a US based legal outsourcing service provider for clients in the US, the UK, Canada and Australia offering services like, legal transcription, legal document preparation, litigation support, legal research, IP litigation support, due diligence, legal coding, legal animation and legal webs site design. The Ethics of Photo Manipulation

Photo manipulation is best and easily done digitally nowadays on a desktop computer. Almost any thing can be done with images and often one does not know what to believe and what not to believe. Such is the technology of today that by just a small adjustment using Photoshop software functions, magical changes can be done on photographs. When photography was invented years ago it was appreciated because it could capture reality perfectly when compared to the paintings and portrait works of those days. But then photo manipulation and the media like cinema and the television soon made it obvious that all what we see need not be real. Most of the time photography is for human entertainment. So where do we draw the line? What is the ethics of photo manipulation? And how is aesthetics involved in it?

The dictionary defines ethics as "a set of moral principles or values". Anything is ethical only when it is conforming to accepted professional standards of conduct. When compared to ethics, aesthetics is about beauty, art and taste and how we handle it. If a photograph is enhanced for the purpose of creating more beauty and appeal it is to be considered ethical. Only when photo manipulation is done with the intention to deceive the viewer does it become unethical. This is a very subtle yet a clear idea though many may debate over it.

It is obvious that if photo manipulation is done to deceive a jury and is shown as false evidence in court it is unethical. But in contrast here is a popular case. We all know that the dinosaurs that have become extinct eons back and when it is created realistically in the famous Hollywood movie "Jurassic Park" there is nothing at all unethical about it. It is accepted world over to be a great work of art by director Steven Spielberg. This is because the viewers expect the maker to deceive them by giving the best possible realistic effect. Thus every situation is unique and the ethics/aesthetics will depends on the people involved and the source of motivation.

If one is a businessman looking for some industry news or is seeking some information about a competitor/ products/services the best place to search is indeed the Internet. Yes this is usually true unless off course you plan to directly spy at the premises of your competitor.

Pricing/financial details are hidden deep in the web probably as PDF documents. Unless we fill web forms give up manual searching and implement automated down loading it is difficult to extract data from the deep web. Blogs and forums online are also very useful in tracking special knowledge or data specific to any industry. However a web extraction tool can have the advantages and features like,
  • Simultaneous board crawling
  • Scheduling tasks
  • Specific content extraction
  • Customized formatted outputs
  • Web crawling
  • Synergizing external data with internal data

E-Discovery /Legal Research only for the Rich?

E discovery based legal research is indeed getting to be very unaffordable for the common man. Recently on 20th March 2007, a US Supreme Court judge (Justice Breyer) for the first time had to speak out on e-discovery during a panel discussion with law professors, industry leaders and other attorneys on the impact of e-discovery held in Georgetown University Law Center. The jurists even warned that if the trend continued only the rich will be able to afford the legal system and others may have to seek alternative avenues like arbitration or simple pleadings. He was worried about the escalating cost of e-discovery. In the judge's own words,

"If it really costs millions to do that (e-discovery), then you're going to drive out of the litigation system a lot of people who ought to be there. They'll go to arbitration . . . They will go somewhere where they will write their own discovery rules, and I think that is unfortunate in many ways."

For more details go to http://technology.findlaw.com/articles/01192/010917.html

The recommendation made at the end of the discussions clearly stated that as per the new FRCP (Federal Rules of Civil Procedure) regulations and amendments, documents retention, email management, data archiving, data retrieval and document management policies were to be consistently implemented and followed by law firms and companies so that legal research and e discovery costs can be curbed over time.

It is true that technology has created a problem by making available access to massive amount of data. However it is also a fact that the courts cannot recommend neglect of the ever-growing vast body of evidence available via electronic information and e-discovery as this would hinder the justice system. The problem has to be skillfully solved with the help of technology and the combined wisdom of IT specialists, and the law and business communities.

Data Cleaning and ETL Tools

Data cleaning is an essential process for maintenance of the data quality in a data warehouse. Whenever data from outside sources has to be incorporated with an existing database, it has to be first cleaned and made fit enough to be added to the old data as only an updated data can become reliable. ETL (Extract, Transform, Load ) tools are used to do data cleaning.

Data cleaning/cleansing is done using ETL tools that basically have to extract data from archival/ operational systems and clean and validate the data according to the specific business requirements followed by loading it into an existing database/ data warehouse. Some of the common ETL tools available in the market today include,
What are the functions of an ETL tool? An ETL tool has to have either an advanced extraction capacity or a transformational function. A good tool will have good strength in both these functions. Also the data source varies from one company to another. While choosing of ETL tools care should be taken to ensure that the tool directly connects to the source of the data. An ETL tool must also have a good scheme of metadata.
